ר׳ אפרים מקלעת חמאד
ר׳ אפרים אבן אבי אלרגאן, usually known as ר׳ אפרים מקלעת חמאד or simply רבנו אפרים, was a major North African halakhist of the late eleventh and early twelfth centuries. He lived in Qalʿat Banī Ḥammād, the Hammadid capital in the central Maghreb, in present-day Algeria. His personal chronology, parentage and exact birth and death dates are unknown. Rabbinic literature also calls him ר׳ אפרים קלעי, ר׳ אפרים הספרדי, ר׳ אפרים הזקן and תלמיד הרי״ף; these epithets sometimes caused later writers to confuse him with the younger Ashkenazic scholar ר׳ אפרים בן יצחק מרגנשבורג, but they were distinct people. ר׳ אפרים was an outstanding student and intellectual colleague of ר׳ יצחק אלפסי. He discussed legal problems directly with his teacher, and ר׳ יצחק אלפסי sometimes accepted his arguments. Material associated with ר׳ אפרים entered the later recension of הלכות הרי״ף, while some marginal annotations were eventually copied into the body of that text. His principal undertaking was the earliest known commentary on הלכות הרי״ף. Medieval authors variously call it הגהות, השגות, תשובות, תוספות or תשלום הלכות. These names describe overlapping functions rather than securely separate books: it supplemented omitted laws, explained quoted Talmudic passages and difficult wording, defended ר׳ יצחק אלפסי against critics, and respectfully challenged him where Geonic or North African rulings and customs pointed elsewhere. The work no longer survives intact, but substantial fragments and quotations—especially on Bava Kamma—permit partial reconstruction. Other remnants show wide activity in Mishnah, Tosefta and Talmud commentary, textual criticism, responsa, practical halakhah and Hebrew grammar. His straightforward comments on Pirkei Avot pay particular attention to literary sequence and the relationship between clauses in a mishnah. His rulings include the influential view that the Talmudic story of Rabbah and ר׳ זירא rejects rather than illustrates a requirement to become intoxicated on Purim, and a position against observing two days of Rosh Hashanah in the Land of Israel. ר׳ שלמה בן אברהם אבן פרחון, author of מחברת הערוך, identifies him as a teacher, confirming his influence beyond narrow legal commentary and into linguistic scholarship. His teachings circulated especially strongly in Provence and Catalonia and were used by ר׳ אברהם בן דוד מפושקיירא, ר׳ זרחיה הלוי, ר׳ יהונתן הכהן מלוניל, ר׳ יצחק בן אבא מארי and ר׳ משה בן נחמן, sometimes without attribution. Claims that ר׳ אפרים followed ר׳ יצחק אלפסי to Lucena, fled to Provence or remained to head an academy at Qalʿat Ḥammād cannot presently be resolved. Accordingly, this biography uses Qalʿat Ḥammād as the sole secure geographic anchor and treats later intellectual transmission as reception, not personal travel.
